Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Charge for Stripe mobile application ("Charge" or "the App"), provided by Summit Digital ("we", "our", or "us"). By downloading, installing, or using Charge, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree to these Terms, you must not use the App. We reserve the right to update these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

2. Description of Service

Charge is a mobile point-of-sale (POS) application that connects to your Stripe account via Stripe Connect. The App allows you to accept payments from your customers using Tap to Pay on iPhone and manual card entry. Charge acts as an interface to your existing Stripe account; all payment processing is performed by Stripe.

3. Stripe Account Required

To use Charge, you must have an active Stripe account in good standing. Your use of Stripe is subject to Stripe's Terms of Service and Stripe Connected Account Agreement. We are not responsible for Stripe's services, decisions, or policies. Any disputes related to payment processing, payouts, or account status should be directed to Stripe.

4. Fees

Charge applies a 1% platform fee on each transaction processed through the App. This fee is in addition to Stripe's standard processing fees and any other fees charged by Stripe. By using the App, you agree to the application of this platform fee. Fee structures may change with notice; continued use of the App after such changes constitutes acceptance.

Charge is an independent application developed by Summit Digital. We are not affiliated with, endorsed by, or sponsored by Stripe, Inc. "Stripe" is a registered trademark of Stripe, Inc. Our use of the Stripe name and integration with Stripe's services is through their publicly available APIs and Stripe Connect platform.

7. No Warranty / As-Is

The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components. We do not guarantee that payment processing will always be available or function without issues, as this depends on Stripe's services and infrastructure.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Summit Digital and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the App, regardless of the theory of liability. Our total liability for any claim arising from your use of the App shall not exceed the total platform fees you have paid to us in the twelve (12) months preceding the claim.

9. Termination

You may stop using Charge and disconnect your Stripe account at any time. We reserve the right to suspend or terminate your access to the App at our sole discretion, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, or misuse of the App. Upon termination, your right to use the App ceases immediately.

10. Intellectual Property

All content, features, and functionality of the App, including but not limited to its design, code, graphics, and trademarks, are owned by Summit Digital and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Summit Digital operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of that jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will notify you through the App or by other appropriate means. The most current version of the Terms will always be available within the App and on our website. Your continued use of the App after any changes constitutes acceptance of the revised Terms.
